Terms and conditions of Marlins Tours
Effective Date: January 12, 2025
Thank you for visiting Marlins Tours.
General information
These terms and conditions govern your participation in any activity offered by Marlins Tours.
By booking the activity, you agree to be bound by these terms and conditions.
Booking and Payment
A deposit of 50% is required to secure your booking.
It can be paid via credit card, wire transfer, sinpe or cash if you are in the area.
The remaining amount must be paid:
High Season (December to April): 7 days prior to the activity.
Low Season (May to November): 48 hours prior to the activity.
Proof of payment must be sent.
Cancellation and Refund Policy
High Season (December to April):
Cancellations made 14 days or more before the scheduled activity will receive a full refund.
Cancellations made between 14 days and 7 days before the scheduled activity will receive a 50% refund.
Cancellations made less than 7 days before the scheduled activity will not be eligible for a refund.
Low Season (May to November):
Cancellations made 7 days or more before the scheduled activity will receive a full refund.
Cancellations made between 7 days and 48 hours before the scheduled activity will receive a 50% refund.
Cancellations made less than 48 hours before the scheduled activity will not be eligible for a refund.
Marlins Tours reserves the right to cancel any activity due to weather conditions, safety concerns, or other unforeseen circumstances. In such cases, you will be offered a full refund or the option to reschedule.
Safety and conduct
Participants must follow all safety instructions provided by Marlins Tours’ team at all times.
Marlins Tours reserves the right to remove any participant from the activity if they are deemed to be a danger to themselves or others.
All participants must sign a liability waiver before participating in the activity.
Health and fitness requirements
It is your responsibility to inform Marlins Tours of any medical conditions or physical limitations that may affect your ability to participate in the activity.
Equipment and liability
Marlins Tours provides all necessary equipment for the activity.
Participants are responsible for the care and return of any equipment provided. Damages or loss of equipment may result in additional charges.
Marlins Tours is not liable for any personal belongings lost or damaged during the activity.
Weather and sea conditions
All activities are subject to weather and sea conditions. Marlins Tours monitors conditions closely and will inform participants if any activity needs to be rescheduled or canceled.
Media
Marlins Tours may take photographs and/or videos during the activity for promotional purposes. If you prefer not to be photographed, please inform Marlins Tours’s team before the activity begins.
Governing law
These terms and conditions are governed by the laws of Costa Rica.
Any disputes arising from these terms and conditions will be subject tot the exclusive jurisdiction of the courts in Costa Rica.
